MyChart is a secure online service provided by Children's Health℠ through which a patient or patient’s parent/legal guardian can obtain limited patient medical information. MyChart is accessible through this site (the "Site") and the mobile app (the “App”). The Site and the App are referred to collectively herein as the "MyChart Services" for purposes of these MyChart Terms of Use. Access to and use of the MyChart Services are subject to the Terms of Use for childrens.com, as well as these MyChart Terms of Use, which are intended to supplement the childrens.com Terms of Use. BY USING THE MYCHART SERVICES, YOU ACCEPT AND AGREE TO BE BOUND BY THE CHILDREN.COM TERMS OF USE AND THE MYCHART TERMS OF USE. IF YOU DO NOT AGREE TO ALL THE TERMS OF USE YOU MAY NOT USE THE MYCHART SERVICES. Children’s Health reserves the right to update or change the terms of use or the MyChart Services at any time without notice to you. The most current version of the terms of use can be reviewed by revisiting this page and the childrens.com Terms of Use. Access to and use of the MyChart Services are also subject to all applicable laws. If there is any conflict between the childrens.com Terms of Use and these MyChart Terms of Use, the MyChart Terms of Use shall take precedence.

The MyChart Services are provided to you for your personal use only and to provide information, education, and communication. Emergency or urgent situations requiring immediate attention SHOULD NOT be submitted electronically through use of the MyChart Services, but users should instead call the patient’s doctor, immediately go to the nearest Emergency Department, or call 911.

You understand and agree that the use of MyChart is entirely at your own discretion and Children’s Health will not be liable for use of the MyChart Services as provided herein and in the childrens.com Terms of Use.

Except as may be expressly provided herein, you must be 18 years old to use the MyChart Services. You represent that you are at least 18 years old.

Copyright

The contents of the MyChart Services, including text, images, graphics, sound files, animation files, audio and video files and their arrangement are subject to copyright and intellectual property protection. The contents may not be used for public or commercial purposes without Children’s Health’s written permission. Material from the MyChart Services may be downloaded for non-commercial and personal use only. Any downloads must retain all copyright and other proprietary notices contained on the materials and may not be altered in any way.

License and Restrictions

You may download and use the App solely for your own personal, non-commercial use.
You may not disassemble, reverse compile or reverse engineer the App or otherwise attempt to obtain or derive the source code or the underlying ideas of the App.
You may not alter, modify, enhance or prepare any derivative work from or of the App.
You may not copy or reproduce the App.
You may not sublicense, distribute, transfer, sell, rent, lease or lend the App.
You may not alter or remove any proprietary notices (such as trademarks or logos) in the App.
You may not engage in any conduct that has a harmful impact on the App or on other users.

All the restrictions listed above are prohibited whether done directly or indirectly by you. You may not cause or permit any party to do any of the prohibited actions listed above.

MyChart and Medical Records

Although MyChart displays certain information from a patient’s medical record, it does not display all information from a patient’s medical record. MYCHART IS NOT INTENDED TO BE A REPLICA OF A PATIENT’S MEDICAL RECORDS AND CANNOT BE SUBSTITUTED FOR A PATIENT’S OFFICIAL MEDICAL RECORDS. Access to MyChart

MyChart Services are accessed through a MyChart account. Parents and legal guardians may request access to their minor child's health information through MyChart. This is a type of proxy access (access by one person to another person's interactive health record). The amount of information the parent will be able to see depends on the age and legal status of the minor. The limits herein do not affect any other right the parent may have to obtain a minor child's records. Parents and legal guardians with proxy access may request and approve a MyChart account for direct access for their child who is an adolescent patient aged 14 to 17.

To set up a MyChart account in order to access the records of a minor, you may fill out a proxy request form or request assistance from the clinic staff. You must be the parent/legal guardian to be granted “proxy” access “(Proxy Access”).
Parents/legal guardians can set up a proxy MyChart account via the request form, and then give permission for patients between 14 and 17 to receive a MyChart account. Once the proxy account is active, the minor patient account may be requested via a self access form.
If you are a patient over the age of 18 you may request a MyChart account via a self access form.

The individual requesting Proxy Access may be required to provide documentation of his/her authority before any account is activated and access is granted. Due to restrictions imposed by state or federal law, there may be circumstances where the parent or legal guardian cannot be allowed Proxy Access or full Proxy Access to a patient’s information on MyChart. Because of these legal requirements, Children’s Health reserves the right to deny access as appropriate under the law.

If the proxy’s legal relationship with the account holder changes, the proxy must immediately inform Children’s Health by calling -Health Information Management at 214-456-2509 or send written notice to Children’s Medical Center of Dallas, Attention: Health Information Management, 1935 Medical District Drive, Dallas, Texas 75235.

The first time you access MyChart you will be required to set up your own user name and password. User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. As a MyChart user, your role in maintaining the security of your medical information is: 1) changing your password on a regular basis, and 2) keeping your login ID and password confidential.

Communications through MyChart

You may be notified by email, text, or an alert message to a mobile device when there is new information to be viewed in your MyChart account. Any person with access to your email, text, or your mobile device will be able to see MyChart notifications. You should take this into account when providing Children’s Health your email address or phone number. Although no private medical information will be sent via email, text, or an alert message to your mobile device, the notifications will state that new billing statements, appointment reminders, new lab results, or other similar types of information are available within MyChart. For any inquiries submitted through MyChart, please allow at least three (3) business days for a response. Children’s Health is only able to respond to electronic communications based on the information you provide. The failure to provide sufficient information could inhibit medical providers from providing accurate and reliable services. You are responsible for checking any responses sent to your MyChart inbox. These messages may contain information important to the patient’s health and medical care.

Privacy Policy

Children’s Health affords the same degree of confidentiality to health information stored on MyChart as is given to health information stored by Children’s Health in any other medium. Firewalls, passwords, encryption, and audit trails are used to safeguard your information. Children’s Health has taken steps to make all information received from our on-line visitors as secure as possible against unauthorized access and use. Any personal information you submit to the MyChart Services is governed by Children’s Health’s Notice of Privacy Practices. Physician Contribution

PHYSICIANS MAY PROVIDE INFORMATION TO YOU THROUGH MYCHART. PHYSICIANS ARE NOT EMPLOYEES OF CHILDREN’S HEALTH AND ARE EITHER MEMBERS OF THE CHILDREN’S HEALTH'S MEDICAL STAFF AND/OR EMPLOYEES OF OTHER INSTITUTIONS OR ORGANIZATIONS.

Security; Risks of Using Secure Sites and Secure Messaging

Children’s Health uses encryption technology and takes other precautions to ensure that the information contained or transmitted via MyChart is as secure as reasonably possible from unauthorized use or access. As such, your browser must be enabled to transmit via Secure Socket Layer (SSL) protocol and 128-bit encryption. If your browser currently does not support this protocol, you will see a prompt asking you to update your security and a link to a site where you may obtain the necessary plug-in at no charge. SSL is used for transmitting personal demographic information, personal health information and credit card information. Children’s Health is using industry-standard encryption technologies to protect and secure the MyChart account, including the secure messaging function. Because communications with Children’s Health using MyChart are carried over a secured, encrypted connection, Children’s Health strongly recommends the use of messaging via MyChart, instead of use of e-mail, for online communications. However, please note that while Children’s Health takes measures to safeguard your security, we cannot guarantee absolute security of the MyChart account against inadvertent disclosure or intentional intrusion. The use of electronic communication systems such as the World Wide Web (including secure messaging) for communications has a number of risks that users should consider before use. Such risks include, but are not limited to, the following:

Electronic communications can be copied, circulated, forwarded and stored, in numerous paper and electronic files.
Electronic communications can be accidentally broadcast worldwide and received by many unintended recipients.
Backup copies of electronic communications may exist even after the originator or recipient has deleted his or her own copy.
Employers and online services have a right to archive and inspect e-mails transmitted through their systems.
Message senders can misaddress a message.
Messages can be intercepted, altered, forwarded, or used without written permission or detection.
E-mail notifications can be used to introduce viruses into computer systems.
Electronic communications may not be answered in the time frame expected by the parties or they can be misinterpreted.
Electronic communications are discoverable and can be used as evidence in court.
Passwords providing access to electronic communications can be stolen and misused, or host systems can be compromised, leading to unauthorized disclosures of personal information. As a result of these risks, Children’s Health cannot guarantee the security and confidentiality of secure messaging and other communication submitted through MyChart, and will not be liable for improper disclosure of confidential information.

MyChart Account Termination and Deactivation

You access to MyChart can be terminated by you or Children’s Health at any time. Children’s Health can terminate your access to the MyChart Services for the failure to abide by the Children’s Health Terms of Use and the MyChart Terms of Use. An account may be deemed abandoned and expired if the account has no activity for two calendar years. To maintain an active status on your account, it is your responsibility to periodically login. Should your account expire, you must re-register to be able to access your account.

Liability

Children’s Health and/or its respective suppliers make no representations about the suitability of the information contained in the information and related graphics published as part of the MyChart Services for any purpose. All such information and related graphics are provided "As Is" without warranty of any kind. Children’s Health and/or its respective suppliers hereby disclaim all warranties and conditions with regard to this information and the MyChart Services, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement. In no event shall Children’s Health and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of information available from the MyChart Services. Children’s Health assumes no responsibility and will have no liability for any circumstances arising out of the use, misuse, interpretation or application of any information supplied through the MyChart Services. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. Children’s Health also assumes no responsibility, and cannot be liable for any damages to, or viruses that may infect, your mobile phone or device, computer equipment or other property on account of (a) you downloading the App, (b) access to, use of, or browsing in the MyChart Services, or (c) your downloading of any materials, data, text, images, video, or audio from the MyChart Services.
